Under federal and Indiana law, if school staff suspects a student may have a learning disability because they’re not making adequate progress, the school is supposed to initiate a request for an evaluation and obtain parental consent.
Parents can also request an IEP evaluation. They must make it verbally or in writing to teachers, school counselors, school psychologists, school social workers, building principals and other school administrators.
Once the parent makes their request, the school has 10 instructional days to provide the parent with written notice that says whether they will conduct the evaluation.

If a student is deemed eligible for an IEP, the case conference committee must meet at least once every year to discuss the child’s IEP. And the student’s case conference committee must reevaluate them for special education services at least once every three years — unless the parent and the school agree that reevaluation isn’t necessary. The school is supposed to notify parents of a reevaluation and obtain their consent. A parent can also request (verbally or in writing) that their child be reevaluated sooner.

Elissa said she didn’t have to do anything other than show up at Kyriakos’ case conference committee, which was made up of educational professionals who decide together what services should be included in a student’s IEP.
“So maybe I'm different from other parents in that I didn't have to struggle at all. In fact, it was an expectation that I would cooperate,” Elissa said. “And the IEP was developed very comprehensively.”
Kyriakos’ IEP included goals and outlined how the school would help him achieve those goals.
“We want Kyriakos to have a fulfilling school experience, you know, where he feels purpose in life, and that he pursues leisure activities, and that he, you know, is able to form close personal relationships,” Elissa said.
She said her son’s goals included a behavioral goal, functional English and literacy goal, functional mathematics, and a functional communication goal; and his services initially included 200 minutes of speech language pathology per month. Kyriakos also received 100 minutes of occupational therapy per month and transportation accommodations.
“Communication is his weakest faculty,” Elissa said. “He still can’t talk at 19.”
